Background: The Provedoria for Human Rights and Justice: Timor-Leste National Human Rights Institution
The PDHJ was established through the National Parliament’s  Law No. 7/2004 in compliance with the 2002 Constitution of the Democratic Republic of East-Timor stipulating the establishment of an “an independent organ in charge of examining and seeking to settle citizens’ complaints against public bodies, preventing and initiating the whole process to remedy injustice”. The PDHJ is an independent national human rights institution which has a mandate to cover human rights and good governance / maladministration.

The first Provedor was elected by Parliament in March 2005 and the PDHJ started effectively functioning in March 2006.

Functions and Powers

The nature of the PDHJ’s operations is set out in Article 5 of the establishing statute, according to which the Office shall operate as an independent statutory body and shall not be subject to the direction, control or influence of any person or authority and have the power to review complaints, conduct investigations and forward to the competent organs the recommendations deemed appropriate to prevent or redress illegality or injustice.

The PDHJ has a broad human rights mandate. It deals with cases of human rights violations, complaints, education and promotion, monitoring and generally integrating human rights into legislation and practices of Timor-Leste.

Structure
PDHJ’s has a central office in Dili and four regional offices in Oecussie, Baucau, Maliana and Same.  


BACKGROUND
UNDP together with OHCHR is engaged in long term capacity development Project of the Provedoria for Human Rights and Justice. The Provedoria for Human Rights and Justice (PDHJ) is the national human rights institution (NHRI) of Timor-Leste.  Its mandate is “to combat corruption and influence peddling, prevent maladministration and protect and promote human rights and fundamental freedoms of natural and legal persons throughout the national territory.” (Article 5, Law 2004/7 on the establishment of the PDHJ). The PDHJ main office is in Dili regional offices have recently been opened in Oecussie, Baucau, Maliana and Maubisse. Building upon the existing human rights knowledge and skills which have been developed through the implementation of the UNDP-OHCHR Capacity Building Project for the Provedoria (2007-2009), the current Project (2010-2014) continues to strengthen the PDHJ’s human rights mandate, the department of public assistance, the four new PDHJ regional offices and the development of the PDHJ’s legal capacity. The project also provides support to the PDHJ institutional planning and management which is seen as crucial to the effective fulfillment of the human rights mandate. The development of an electronic case management system to reflect PDHJ’s case handling procedures is a critical aspect of the development of sound information management within the PDHJ. The casemanagement system will be developed in conjunction with Ausaid’s Justice Facility.

SCOPE OF WORKS AND DUTIES
Reporting directly to the Project Manager and in coordination with the Provedor for Human Rights and Justice and the PDHJ Director of Finance and Administration the IT Consultant will undertake the following tasks:

  • In close consultation with Project Manager, relevant staff of PDHJ and Justice Facility Consultants contribute to planning, consultation and development of the client server database system to reflect the case management system and reporting needs of the Provedoria for Human Rights and Justice (PDHJ);
  • Lead the development of documentation of PDHJ case handling work process to be provided to Justice Facility Consultants for the development of the electronic case management system;
  • Provide support to the development of the electronic case management system as required by Justice Facility Consultants;   
  • Lead consultation and verification of documentation to be provided by and to PDHJ by electronic case management developers;
  • Lead the implementation of the electronic case management system in the PDHJ;
  • Provide trouble-shooting support to the operation of the electronic case management system;
  • Provide mentoring and training to strengthen the capacity of the PDHJ IT officials in relation to development and maintenance of client server database and other areas as required;
  • Provide training and mentoring to support the PDHJ staff and management on operation, and utilization of the database;
  • Provide mentoring and technical assistance for the new PDHJ IT staff on systems, equipment, administration, installation, maintenance and upgrading;
  • Other duties related to IT at the PDHJ as required by the PDHJ and or Project Manager.


OUTPUTS:
  • By end of June 2012 all documentation on PDHJ case handling procedures are documented for electronic case management developers;
  • By end of August 2012 PDHJ electronic case management system is installed and tested  in PDHJ ( it is noted that this output is dependent collaborative work by IT Consultant, Project Manager, Justice Facility contractors);
  • By end of October 2012 PDHJ manuals for IT and the users on the system are developed in relevant language ( this is joint output with Justice Facility)
  • By end of December 2012 PDHJ users are trained in system and competent to use; 
  • By end of December 2012 PDHJ documentation of the system is stored centrally; 
  • By end of March 2013 PDHJ IT staff are trained in source code and maintenance of system (this output is to be achieved collaboratively with UNDP CFJ training programme).

QUALIFICATIONS 
  • Bachelors of IT.

EXPERIENCE
  • At least 5 years experience in Information technology with focus on networking, database development and help desk functions; 
  • Experience in documenting work processes for development of IT systems; 
  • Experience in capacity development; 
  • Experience in working in a NHRI or Ombudsman’s Office an advantage
  • Experience working in post conflict countries or Timor Leste an advantage.
  
Language Requirements:
  • Excellent English Language skills are essential and Tetun and or Portuguese language skills are a clear advantage.

Individual consultants must submit the financial proposal with a workplan. The financial proposal should include all necessary fees and cost related to the assignment, except the travel cost at the beginning and at the end of the assignment which UNDP will pay. UNDP will not cover any other additional expenses outside of the financial proposal. The financial proposal should be reasonable based on the TOR and proposed workplan.
